Terms of Service – LUSILECTRA Online Store

1. Identification and Purpose
1.1. The online store available at www.lusitools.com (hereinafter, “Online Store”) is operated by LUSILECTRA – VEÍCULOS E EQUIPAMENTOS, S.A., headquartered at Rua Eng.º Ferreira Dias, n.º 993, 4100-247 Porto, NIPC 501381430, share capital € 5,300,000.00 (hereinafter, “LUSILECTRA”).
1.2. These Terms of Service regulate the access, navigation, and use of the Online Store, as well as the purchase of products and services made available therein (hereinafter, “Products”).
1.3. By using the Online Store or submitting an order, the customer (hereinafter, “Customer”) accepts, without reservations, these Terms.

3. Eligibility and Account
3.1. The Online Store can be used without registration. Alternatively, the Customer can create a registration associated with their profile at www.lusitools.com, committing to keep data accurate, current, and complete.
3.2. The Customer declares to be 18 years old or, acting on behalf of a legal entity, to have powers of representation.
3.3. The Customer is responsible for access credentials and for all activity under their account, and must notify LUSILECTRA of any misuse.
4. Information about Products and Prices
4.1. All Products are new and described regarding technical characteristics, accessories, and conditions of use.
4.2. LUSILECTRA may change at any time information, specifications, promotional actions, and prices.
4.3. Prices are presented in euros, include VAT at the legal rate, and are valid only for online purchases, and may differ from physical stores.
4.4. LUSILECTRA makes best efforts to ensure accuracy of content, but is not responsible for errors or omissions. In case of an obvious pricing error (manifestly excessive or negligible), the Customer will be contacted to: (i) confirm the purchase at the correct price; or (ii) cancel with full refund. If contact is not possible within 15 days, the order may be cancelled with refund.
5. Availability, Order and Acceptance
5.1. Submitting the order constitutes a purchase proposal by the Customer; acceptance occurs after payment confirmation and stock verification.
5.2. In case of unavailability after payment, the Customer may choose refund (Product + associated shipping) or, when possible, wait for restocking. If there is no consensual solution or contact, LUSILECTRA cancels and refunds by the same payment method.
6. Payment and Invoicing Methods
6.1. Available methods:
- Multibanco Reference (ATM/Homebanking) – valid until the deadline indicated in the order confirmation; if not paid within the deadline = automatic cancellation.
- Credit card – processing via SIBS, IFTHENPAY or Shopify Payments; the purchase is cancelled if the platform rejects the payment.

MB WAY – confirmation in the app associated with the indicated mobile number.
6.2. By paying, the Customer consents to the issuance of an electronic invoice sent to the indicated email.
7. Deliveries, Deadlines and Areas
7.1. Geographical scope: Portugal and Spain.
7.2. Methods:
- In-store pickup (Porto): only after confirmation of availability at the location, within business hours.

Home delivery: carried out by a carrier, according to the terms and procedures of the carrier; shipping costs are borne by the Customer, unless otherwise indicated.
7.3. Indicative deadlines are merely informative and depend on third parties/logistics.
7.4. Transfer of risk: occurs upon delivery to the Customer or a third party designated by them.
7.5. Inspection upon receipt: any apparent damage/fault must be reported immediately and, preferably, within 48 hours, keeping the original packaging and contents.
8. Retention of Title
8.1. Ownership of the Products remains with LUSILECTRA until full payment of the price.
9. Right of Free Resolution (Consumers)
9.1. If the Client is a consumer, they may freely terminate the contract within 14 days from physical possession of the goods.
9.2. You must send an unequivocal statement to info@lusitools.com; you may use the provided form template.
9.3. LUSILECTRA refunds all payments, including delivery costs (up to the most economical method), within 14 days from receipt of the decision, and may withhold until receipt of the goods or proof of shipment.
9.4. Return costs: borne by the Client (unless otherwise indicated).
9.5. The Client is responsible for depreciation resulting from handling beyond what is necessary to verify the nature, characteristics, and functioning.
9.6. Common exclusions: customized goods; sealed health/hygiene goods opened; software/licenses opened/activated.

10. Returns for Non-Compliance / Defect / Error
10.1. In case of defect, non-compliance or shipping error, LUSILECTRA ensures repair, replacement, collection and/or refund at no cost to the Client, as applicable.
10.2. The Client must report by email to info@lusitools.com, attaching order number and evidence (photos/videos).
10.3. Transport damage must be reported as soon as detected and preferably within 48 hours after delivery.
11. Warranties
11.1. Consumers: legal warranty minimum of 3 years (a longer contractual warranty may exist if indicated on the Product page).
11.2. Non-consumers (B2B): warranty of 6 months.
11.3. The warranty does not cover wear and tear, improper installation, use contrary to instructions, unauthorized interventions, accidental damage or due to abnormal conditions (humidity, dust, power surges, etc.).
12. Return Conditions (general rules)
12.1. The Product must be returned complete, with accessories, manuals, and original packaging in good condition; labels/serial numbers intact.
12.2. LUSILECTRA may refuse returns of items installed, used, damaged or with missing components; electrical/electronic parts and consumables opened/installed may not be eligible, except for validated defect.
13. Professional Clients (B2B)
13.1. The right of withdrawal does not apply to professional purchases.
13.2. B2B returns (non-defective) require prior consent and may be subject to a restocking fee and specific conditions (deadlines/state).
14. Liability and Limitations
14.1. LUSILECTRA is not liable for temporary or permanent interruptions/suspensions of the site due to technical, administrative or force majeure reasons.
14.2. LUSILECTRA does not guarantee freedom from viruses or other harmful elements, and the Customer is responsible for security measures.
14.3. Except in cases of willful misconduct or gross negligence, LUSILECTRA's liability for direct damages arising from online purchase is limited to the price paid for the Product in question.
14.4. Under no circumstances shall LUSILECTRA be liable for lost profits, data loss, indirect or consequential damages.
15. Intellectual Property
15.1. The site, design, texts, images, brands, logos and associated content are protected.
15.2. The use, reproduction, modification, distribution or commercial exploitation without prior authorization from LUSILECTRA or the legitimate holders is prohibited.
16. Personal Data, Privacy and Cookies
16.1. The processing of personal data complies with the Privacy and Personal Data Protection Policy available at: lusitools.com/pages/politica-privacidade.

16.3. The use of the site may involve cookies; see the Cookie Policy (when applicable).
17. Fraud, Security and Suspension
17.1. LUSILECTRA may refuse, block or cancel orders in case of suspected fraud, abusive use, or violation of these Terms.
17.2. LUSILECTRA may suspend access of the Customer who compromises the security, integrity, or operation of the Online Store.
18. Third Parties, Links and Payment Tools
18.1. Certain services (payment, transport, tracking) are provided by third parties under their terms and policies.
18.2. External links are provided for convenience; LUSILECTRA is not responsible for third-party content/policies.
19. Communications and Evidence
19.1. The Customer accepts electronic communications (email/SMS) related to orders, payments, and after-sales service.
19.2. The electronic records maintained by LUSILECTRA constitute evidence of the operations and communications carried out.
20. Promotions, Vouchers, and Codes
20.1. Promotional campaigns, vouchers, or codes may have limited duration, specific conditions, and are not cumulative, unless expressly indicated.
20.2. In case of return with refund, the component obtained by voucher may be reverted to a voucher with the same original conditions.
21. Changes to the Terms
21.1. LUSILECTRA may update these Terms at any time, without prior notice.
21.2. The Terms in force at the date of website use or purchase conclusion apply.
22. Alternative Dispute Resolution (Consumers)
22.1. If the Customer is a consumer, they may resort to a competent RAL entity for disputes up to € 5,000.
22.2. The List of Arbitration Centers is available on the Directorate-General for the Consumer website: consumidor.gov.pt/ral-mapa-e-lista-de-entidades.
23. Law and Jurisdiction
23.1. These Terms are governed by Portuguese law.
23.2. For any disputes, the Portuguese court with territorial jurisdiction is competent, without prejudice to mandatory rules applicable to consumers.
24. Final Provisions
24.1. Partial invalidity: the invalidity of any clause does not affect the validity of the remaining ones.
24.2. Assignment: LUSILECTRA may assign contractual position in the context of corporate reorganization; the Customer may not assign without consent.
24.3. Language: in case of discrepancy between versions, Portuguese prevails.
24.4. Integration: these Terms, the Return and Refund Policy, the Privacy Policy, and the specific Product information constitute the entire agreement between the parties for online purchases.
